Definitions
“Platform” or “Amby” means the website and related tools operated to connect customers with event-service providers.
“Operator” means the entity operating Amby (contact: amby.spaces@gmail.com).
“User” means anyone who browses, registers, or otherwise uses Amby.
“Customer” means a User who submits inquiries or purchases event tickets.
“Provider” means a User who lists services or sells event tickets on Amby.
“Platform Service” means the electronic service consisting of account access, search, listings, messaging, calendars, and—where enabled—online payment facilitation provided by the Operator.
“User Contract” means any agreement for an event-related service or ticket concluded directly between a Customer and a Provider. The Operator is not a party to User Contracts unless we explicitly state otherwise in writing.
Agreement
These Terms of Service (“Terms”) govern your use of Amby and set out the terms of the electronic services contract between you and the Operator under the Polish Act of 18 July 2002 on Providing Services by Electronic Means.
By creating an account or using Amby, you confirm that you have read these Terms and our Privacy Policy and accept them. If you do not agree, do not use the Platform.
Features, availability, and fees may change. Material changes are described under Changes below.
Role of Amby
Amby operates solely as a technical intermediary and hosting platform. We provide IT infrastructure that enables Users to publish offers, exchange messages, negotiate terms, and—where available—pay online.
When a Customer and a Provider agree on an event service, or when an event ticket is sold, the User Contract is concluded exclusively between those Users. The Operator does not supply venues, entertainment, floristry, photography, transport, or other event services shown on Amby and does not employ Providers.
The Operator is responsible for operating the Platform Service: maintaining the website, account functions, moderation and safety tools, and payment facilitation as described in these Terms. Except where mandatory law requires otherwise, the Operator is not responsible for how Users perform User Contracts, including quality, safety, legality, timing, cancellations, or refunds for event services themselves.
Listings, prices, and messages are supplied by Users. The Operator does not guarantee that any content is complete, current, or lawful.
The Platform Service
Amby helps Customers find event-related services (venues, music, florists, photography, transport, and similar), send inquiries, negotiate in chat, and—where enabled—pay online. Event tickets may be sold for organized events published by Providers.
A booking is confirmed only after you agree with the provider and complete payment (or the provider confirms off-platform payment) according to the product rules.
We do not guarantee that any Provider will accept an inquiry, that listings are accurate, or that a particular date remains available.
Accounts
Only adults or persons with full legal capacity may use the service.
You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account.
One person may hold a unified account with customer and optional provider capabilities. Provider listings may require identity verification and admin approval before appearing in public search.
Inquiries and messages
Customers submit inquiries with event dates and messages. Providers may reply, propose prices, decline, or lock dates while an inquiry is active according to product rules.
Either party may stop participating; inquiries that go quiet may expire automatically after a defined period without messages.
You must communicate respectfully and only for legitimate event-service purposes. Do not share illegal content, spam, or harassment.
Provider listings
Providers are responsible for the accuracy of listings, pricing, availability, and compliance with applicable laws (including consumer and tax rules).
We may review, reject, deactivate, or remove listings that violate these Terms or harm users. Draft and pending listings are not public until approved.
Payments
Where online payments are enabled, checkout is processed by Stripe (or another licensed payment institution identified at checkout). By paying, you also accept that provider’s applicable terms.
For inquiry bookings paid through Amby, funds are collected on behalf of the Provider via Stripe Connect. Amby retains a platform fee (currently 1.4% of the amount paid) before the remainder is transferred to the Provider. This fee is Amby’s charge for the Platform Service only. Stripe’s own payment-processing fees are separate, are not included in the 1.4%, and apply according to Stripe’s pricing and terms.
Providers may confirm that payment was received outside Amby. In that case no platform fee is charged through Amby and the Operator is not involved in settlement between the Users.
Event tickets are sold only through online checkout when payments are configured. The same platform fee and separate Stripe charges apply. The ticket sale is a User Contract between the Customer and the Provider operating the event; Amby facilitates payment collection only.
Chargebacks, payment errors, and tax invoicing for event services are primarily matters between the paying User, the Provider, and the payment provider. Contact the other party to the User Contract first. For technical payment issues on the Platform, contact amby.spaces@gmail.com.
Your content
You retain rights to content you submit. You grant us a non-exclusive licence to host, display, and process that content to operate Amby (including showing listings and inquiry threads to the relevant parties).
You confirm you have rights to photos and text you upload and that they do not infringe third-party rights.
Prohibited use
You may not misuse the platform, attempt unauthorized access, scrape at scale, impersonate others, or use Amby for unlawful discrimination or fraud.
We may suspend or close accounts that violate these Terms.
Consumer information and complaints
If you are a consumer, mandatory rights under Polish and EU law apply to contracts to which you are a party. These Terms do not limit rights you have against another User under a User Contract.
Complaints about the Platform Service itself (e.g. account access, website errors, or technical payment failures on Amby) may be sent to amby.spaces@gmail.com. We will respond within 14 days where required by law.
Complaints about an event service, cancellation, or refund of a booking must be directed to the Provider (or Customer, if you are the Provider) who is party to the User Contract.
Consumers may use the EU online dispute resolution platform at https://ec.europa.eu/consumers/odr and may contact their local consumer authority (e.g. the President of UOKiK in Poland).
Disclaimer and liability
The Platform Service is provided “as is” within the scope permitted by Polish law. The Operator does not warrant uninterrupted or error-free operation.
The Operator is not a party to User Contracts and is not liable for non-performance, defects, accidents, cancellations, or disputes arising from services provided by Users, except where mandatory law provides otherwise.
Nothing in these Terms excludes or limits the Operator’s liability for intentional damage, gross negligence, or other cases where limitation is prohibited by law (including non-waivable consumer rights toward the Operator under the contract for the Platform Service).
To the maximum extent permitted by law, the Operator’s total liability to a User for claims relating to the Platform Service—not User Contracts—is limited to the greater of (a) platform fees paid by that User to the Operator in the twelve months before the claim, or (b) PLN 100.
Termination
You may close your account at any time from Account settings (see Data deletion). We may terminate or restrict access if you breach these Terms or if we discontinue the service.
Provisions that by nature should survive (e.g. liability limits where valid) survive termination.
Governing law
These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. Courts in Poland have non-exclusive jurisdiction unless mandatory consumer law in your country requires otherwise.
Changes
We may update these Terms. Material changes will be posted on this page with a new date. Continued use after the effective date constitutes acceptance.
